Grandparents' Rights

Under certain circumstances grandparents may seek possession and access to their grandchild. For a grandparent to obtain possession and access they have to show that (1) both parents have not had their parental rights terminated, (2) denial of possession and access to the child by the grandparent would significantly impair the child's physical health or emotional well being, and (3) the grandparent seeking possession and access is the parent of the parent of the child and that parent of the child is incarcerated, been found incompetent, is dead, or does not have actual court ordered possession of or access to the child If you have further questions please do not hesitate to contact our office for a consultation.
